1. Agreement to Terms

These Terms & Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or “customer”), and Al Danube Building Material LLC (“DBMstore”, “we”, “us”, or “our”), concerning your access to and use of the dbmstore.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing the Site and/or placing an order, you agree that you have read, understood, and agree to be bound by all of these Terms & Conditions. If you do not agree with all of these terms, you are expressly prohibited from using the Site and you must discontinue use immediately.

2. User Accounts

You may be required to register an account with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable. All accounts are considered standard customer accounts.

3. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

4. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Site, you agree not to:

Use the Site in a manner inconsistent with any applicable laws or regulations.
Attempt to impersonate another user or person.
Use any information obtained from the Site in order to harass, abuse, or harm another person.
Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material that interferes with any party’s uninterrupted use and enjoyment of the Site.

5. Products & Disclaimers

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site.

Image Disclaimer: We do not guarantee that the colors, textures, or details of the products shown on your screen will be accurate. Product images are for illustrative purposes and the actual product may vary.
Customer Responsibility: You are responsible for verifying all technical specifications, dimensions, and compatibility of products for your specific needs before ordering and installation. We are not liable for issues arising from a product being unsuitable for a purpose that was not verified by you.

6. Orders, Quotes & Payment

Order Confirmation: After you place an order, you will receive an order confirmation email. This email serves as a receipt of your order and does not constitute a binding contract. We reserve the right to cancel or amend an order after it has been placed for reasons including, but not limited to: stock unavailability, damage to stock, pricing errors, or rejection of the order by a third-party vendor. Any such amendment or cancellation will be done with your consent.
Online Quotes: You may generate a quote for products on the Site. All generated quotes are valid for a period of seven (7) days. A quote does not guarantee stock availability. You must confirm stock levels with us at the time of placing an order based on a quote.
Payment: We accept payment via Credit/Debit Card through our secure payment processor, Amazon Payfort. We do not currently accept other payment methods such as Cash on Delivery or Bank Transfer. All payments must be made in UAE Dirhams (AED).

7. Marketplace & Third-Party Sellers

The Site functions as a marketplace, featuring products sold directly by us and by independent third-party sellers ("Sellers").

Contract of Sale: When you purchase a product from a Seller on our Site, the legal contract for the sale and purchase of that product is solely between you and the Seller. Al Danube Building Material LLC is not a party to that contract.
Our Role: We act as a facilitator to allow you to transact with Sellers. Our role is limited to processing payments via our platform and, in some cases, facilitating the logistics.
Disclaimer: We do not take responsibility or guarantee the quality, safety, legality, or accuracy of items listed by third-party Sellers.

8. Shipping & Delivery

Our full shipping terms are detailed in our Shipping Policy. By agreeing to these terms, you also agree to the following:

Customer's Obligation for Access: For deliveries involving large or heavy materials, you are responsible for ensuring that a suitable and legal parking space is available for our delivery vehicle to offload the materials. Failure to provide adequate access may result in delivery delays or the need to reschedule, for which you may be responsible.

9. Warranties Disclaimer

Al Danube Building Material LLC does not offer any direct warranty on the products sold on the Site. Products may be covered by a manufacturer's warranty. We will pass on the benefit of any such manufacturer's warranty to you. All warranty claims should be directed according to the terms and procedures outlined by the specific product's manufacturer.

10. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages. We shall not be liable for any damages or losses arising from:

The improper installation of any product.
Customer negligence in handling or storing materials.
Misuse or mishandling of products contrary to manufacturer guidelines.

Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the product(s) in question.

11. Governing Law & Dispute Resolution

These Terms & Conditions and your use of the Site are governed by and construed in accordance with the laws of the United Arab Emirates as applicable in the Emirate of Dubai. Any disputes arising out of or in connection with these terms shall be resolved exclusively in the Courts of Dubai.
